Medi Ready Kids – Product Purchase Terms and Conditions

1. DEFINITIONS

The following expressions used in these Terms and Conditions have the following meanings,

unless the context clearly requires otherwise:

a) Claim means, in relation to a person, a claim, demand, remedy, suit, injury, damage, loss, cost, liability, action, proceeding, right of action, claim for compensation or reimbursement or liability incurred by or to be made or recovered by or against the person or company, however arising and whether ascertained or unascertained, or immediate, future or contingent.

b) Customer (you / your) means the person or entity purchasing the Goods from Medi Ready Kids.

c) Fee means the purchase price payable by the Customer to Medi Ready Kids for the Goods, as specified at the time of order, inclusive of any applicable taxes.

d) Goods includes any guides, educational materials, information packs, resources, templates, programs, or other written, visual, or digital content created or supplied by Medi Ready Kids for the purpose of supporting parents, schools, or kindergartens to prepare children for medical procedures, and any related documentation, improvements, or updates.

e) IP means all intellectual and industrial property rights (including copyright and related rights), all rights in relation to inventions (including patents), all registered and unregistered trade marks, all rights relating to registered designs, and all other rights resulting from intellectual activity in the artistic, literary or scientific fields, excluding any moral rights.

f) Medi Ready Kids means Jessica Vera Tascone trading as Medi Ready Kids ABN 80 516 285 198 and includes any related entities, officers, employees, agents, or contractors.

g) Obligation means any express or implied legal, equitable, contractual, statutory or other obligation, promise, agreement, covenant, commitment, duty, undertaking or liability.

h) Parties means you and Medi Ready Kids.

i) Personal Information has the definition attributed to it under the Privacy Act 1988 (Cth).

j) Terms and Conditions means the Terms and Conditions set out in this document.

2. GENERAL

When you make a purchase from Medi Ready Kids, you acknowledge and agree that:

a) you have read, understood, and agree to be bound by these Terms and Conditions;

b) these Terms and Conditions apply to all purchases, downloads, and use of any Goods provided by Medi Ready Kids;

c) Medi Ready Kids may update these Terms and Conditions from time to time. Updated Terms will apply to all future purchases, and Medi Ready Kids will notify you of any material changes that may affect you; and

d) each party acts as an independent contractor and not as an agent, partner, or joint venturer of the other. You have no authority to bind Medi Ready Kids or create any obligation on its behalf, express or implied.

3. ENTIRE AGREEMENT

a) These Terms and Conditions constitute the entire agreement between the Parties with respect to the purchase of Goods and supersede all prior representations, discussions, or agreements.

b) You fully indemnify and hold Medi Ready Kids harmless from any Claim based on terms or representations outside of these Terms and Conditions

4. DISCLAIMER – NO MEDICAL OR HEALTH ADVICE

a) You acknowledge and agree that all Goods, including any guides, educational resources, information packs, or other materials supplied by Medi Ready Kids, are provided for general educational and informational purposes only. They are not medical, health, or professional advice and must not be relied upon as such.

b) Without limiting the foregoing, you acknowledge and agree that:

i. the information provided does not replace consultation with qualified medical or health professionals, nor is it intended to diagnose, treat, cure, or prevent any medical condition; ii. Medi Ready Kids does not warrant or represent that any information, product, or guide is accurate, complete, up-to-date, or suitable for your individual circumstances or those of your child;

iii. you are solely responsible for determining the appropriateness, accuracy, and suitability of any information or resource for your personal circumstances and for obtaining professional medical advice where required;

iv. you use all Goods, information, and materials provided by Medi Ready Kids at your own risk; and

v. to the maximum extent permitted by law, Medi Ready Kids expressly disclaims all liability for any loss, injury, claim, or damage arising directly or indirectly from your reliance on, or use or misuse of, the Goods or any information provided.

5. OWNERSHIP OF INTELLECTUAL PROPERTY

a) All intellectual property rights in the Goods remain the exclusive property of Medi Ready Kids.

b) Upon full payment of the Fee, you are granted a non-exclusive, non-transferable licence to use the purchased Goods for personal or internal educational purposes only.

c) You must not copy, reproduce, distribute, modify, adapt, or resell the Goods or any part thereof without the prior written consent of Medi Ready Kids.

d) Any unauthorised use of the Goods constitutes an infringement of Medi Ready Kids’ intellectual property rights and may result in legal action.

6. FEES AND PAYMENT

a) All Fees are payable in Australian dollars (AUD) at the time of purchase.

b) Payment is required in full prior to accessing or downloading the Goods.

c) Medi Ready Kids reserves the right to change its prices at any time, provided that such changes will not affect any purchases already completed.

7. DELIVERY OF GOODS

a) Upon successful payment, you will receive a confirmation email and download link or other access to the purchased Goods.

b) Medi Ready Kids is not responsible for any delay or failure to deliver caused by circumstances beyond its reasonable control, including internet or server issues.

c) If you do not receive access within a reasonable period, you must contact Medi Ready Kids at hello@medireadykids.com.au for assistance.

d) You acknowledge that access to the Goods may require a stable internet connection, compatible device, and software capable of opening standard document formats (e.g., PDF). Medi Ready Kids is not responsible for technical issues, incompatibility, or loss of access due to device settings, browser configurations, or internet interruptions.

8. REFUNDS

a) Due to the digital and informational nature of the Goods, all sales are final. Medi Ready Kids does not offer refunds, returns, or exchanges for change of mind, accidental purchase, or non-use.

b) Once the Goods have been purchased, downloaded, accessed, or otherwise made available to you, the transaction is deemed complete and non-refundable.

c) You acknowledge that digital products cannot be “returned” in the same manner as physical goods and that access to such materials constitutes delivery in full.

d) Refunds will only be provided where required by Australian Consumer Law. In such circumstances, Medi Ready Kids reserves the right to offer a replacement or alternative remedy at its sole discretion.

e) By completing your purchase, you confirm your understanding and acceptance of this refund policy.

9. PRIVACY

a) Medi Ready Kids may collect and store Personal Information about you for the purpose of processing purchases and providing customer support.

b) By purchasing Goods, you consent to the collection, use, and disclosure of your Personal Information in accordance with the Privacy Act 1988 (Cth).

c) Your information may be transferred or stored securely outside Australia for processing by third-party service providers.

10. LIMITATION OF LIABILITY

a) To the maximum extent permitted by law, Medi Ready Kids excludes all express, implied, and statutory warranties.

b) Where liability cannot be excluded, Medi Ready Kids’ total liability is limited to the resupply of the Goods or a refund equal to the purchase price of the Goods.

c) Medi Ready Kids will not be liable for any indirect, incidental, special, or consequential loss, injury, or damage arising out of or in connection with the use of the Goods.

11. CONSUMER GUARANTEES

Nothing in these Terms and Conditions is intended to exclude or limit any guarantees, rights, or remedies you may have under the Australian Consumer Law (ACL). However, to the extent permitted by law, Medi Ready Kids excludes all other warranties and representations, whether express or implied, in relation to the Goods.

12. CONFIDENTIALITY

a) The Parties agree to maintain in strict confidence all confidential information obtained in connection with these Terms and Conditions and not to disclose such information except as required by law.

b) This obligation continues for five (5) years after the date of purchase.

13. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of Victoria, Australia. Each Party submits to the exclusive jurisdiction of the courts of Victoria and any courts competent to hear appeals from those courts.

14. ELECTRONIC COMMUNICATION

You consent to receive all communications, agreements, and notices electronically from Medi Ready Kids, including by email or via the Medi Ready Kids website.

15. SEVERABILITY

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

16. FORCE MAJEURE

Neither Party will be liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure is due to causes beyond its reasonable control, including natural disasters, power failures, internet outages, or government restrictions.
